利用規約

1. はじめに

本アプリ（以下、「本サービス」といいます。）の利用規約（以下、「本規約」といいます。）は、本サービスを提供する当団体（以下、「当団体」といいます。）と、本サービスの利用者（以下、「ユーザー」といいます。）との間の関係を定めるものです。本サービスを利用する前に、本規約をよくお読みください。

2. サービス内容

本サービスは、ユーザーがオンラインで漫画を作成し、共有することができるプラットフォームを提供します。ユーザーは自由に画像をアップロードし、漫画の作成に利用することができます。

3. 著作権

本サービスを通じて作成された画像、漫画、コンテンツ（以下、「ユーザーコンテンツ」といいます。）の著作権は、作成したユーザーに帰属します。ただし、ユーザーは、本サービスの提供、改善、プロモーションのために、当団体に対し、非独占的な使用権を無償で付与するものとします。

4. 元画像に関する権利と義務

ユーザーが本サービスで使用する元画像に関して、ユーザーは、当該画像の使用権を保有している、または使用権を得るための全ての権利、許可、および承諾を有していることを保証するものとします。当団体は、ユーザーがアップロードまたは使用する画像に関して、一切の責任を負いません。ユーザーは、元画像の使用に関連して第三者からの請求があった場合、自己の費用と責任でこれを解決するものとします。

5. 禁止事項

ユーザーは、以下の行為を行ってはなりません。

• 法律、規則に違反する行為
• 第三者の著作権、商標権等の知的財産権を侵害する行為
• 当団体、他のユーザー、または第三者を誹謗中傷する行為
• 性的な表現や暴力的な表現など、18歳未満の閲覧に適さないコンテンツ（いわゆる「18禁」コンテンツ）を投稿・共有する行為
• わいせつ物、ポルノグラフィー、または日本の法律・条例で定められた青少年保護の観点から規制されるコンテンツの投稿・共有
• その他、当団体が不適切と判断する行為

6. コンテンツの削除および公開停止

当団体は、以下の場合において、事前の通知なくユーザーコンテンツの削除または公開停止を行う権利を有します。

• 本規約に違反するコンテンツであると当団体が判断した場合
• 法令または公序良俗に反するコンテンツであると当団体が判断した場合
• 第三者の権利を侵害するコンテンツであると当団体が判断した場合
• その他、当団体の裁量により不適切と判断したコンテンツの場合

当団体による公開停止または削除の判断について、ユーザーは異議を申し立てることができません。また、当団体は、コンテンツの削除または公開停止によりユーザーに生じた損害について、一切の責任を負わないものとします。

7. 免責事項

• 当団体は、ユーザーが本サービスを通じて作成、共有したコンテンツに関して、一切の責任を負わないものとします。
• 当団体は、本サービスの中断、停止、利用不能、またはデータの消失、データの送受信の遅延、またはデータの不正アクセスによる損害について、一切の責任を負わないものとします。
• ユーザーが画像等の生成時に複雑なプロンプトを入力した場合や、センシティブな内容を含む画像生成を試みた際に、画像生成サービスの仕様上、意図した通りの結果が得られない場合があります。このようなケースにおいても、当団体は返金等の責任を負いません。

8. 本規約の変更

当団体は、必要に応じて本規約を変更することがあります。変更後の本規約は、本サービス内での掲示、またはその他の適切な方法により、ユーザーに通知されます。

9. アカウント関連

本サービスのアカウントに関して、以下の規定を設けます。

• ユーザーは、原則として1人につき1つのアカウントを作成することができます。複数アカウントの所持は、それぞれが明確に異なる目的（例：一般創作用と商業活動用など）である場合のみ許可されます。
• 同一人物による複数アカウントを利用した不正行為（投票の操作、ランキング操作など）は禁止され、全てのアカウントが停止される可能性があります。
• 6ヶ月以上ログインがない長期未使用アカウントについては、当団体は事前通知の上、アカウントの一時停止または削除を行う権利を有します。
• 長期未使用アカウントの再開を希望する場合は、所定の手続きにより再開が可能です。ただし、アカウント情報やコンテンツが既に削除されている場合は復旧できないことがあります。
• アカウントの譲渡、売買、貸与は禁止します。発覚した場合、該当アカウントは停止される場合があります。

10. 収益化に関する規定

本サービスを通じて作成・公開されたコンテンツの収益化について、以下の規定を設けます。

• ユーザーは、自身が作成した作品について、本サービス外での商用利用（書籍化、グッズ化等）を行う権利を有します。
• ただし、二次創作作品については、原作の権利者が定める利用規約やガイドラインに従う必要があります。
• 本サービス内でのクリエイター支援機能（投げ銭、サポート等）を利用する場合、別途定める手数料が発生する場合があります。
• 収益化を目的とした以下の行為は禁止します：
  • 虚偽または誤解を招く内容による閲覧数の不正な獲得
  • 他者の作品の無断流用による収益化
  • システムの脆弱性を利用した収益の獲得
• 当団体は、収益化に関するルールに違反したユーザーに対して、収益の没収、アカウントの停止等の措置を取る権利を有します。

11. サブスクリプションとポイントに関する規定

本サービスでは、ユーザーが毎月定額の料金を支払うことにより、ポイントを定期的に付与するサブスクリプションプランを提供する場合があります（以下、「サブスクリプション」といいます）。また、ポイントは本サービス内の各種機能（例：画像生成機能等）の利用時に消費されるものとします。

• サブスクリプションの内容：
  ユーザーがサブスクリプションを利用する場合、月額料金、ポイント付与量、決済方法などの詳細は当団体が定めるガイドライン・アプリ内表示等で案内されます。
• 支払いおよび解約：
  サブスクリプションの料金支払いは当団体が定める決済方法に従うものとします。解約を希望する場合、ユーザーは当団体所定の手続きにより解約手続きを行い、手続きが完了した時点で解約となります。解約のタイミングによっては、既に支払われた料金の返金が行われない場合があります。
• ポイントの利用および消費：
  ユーザーが保有するポイントは、本サービス内で定められた各機能の利用時に消費されます。ポイント消費量は当団体の裁量により変更されることがあり、変更を行う場合は、原則として変更予定日の30日前までにユーザーへ通知します。
• 料金・ポイント付与量等の変更：
  当団体は、サブスクリプションの料金や付与ポイント数などのプラン内容を変更することができます。変更の際は、原則として変更予定日の30日前までにユーザーに対してアプリ内またはその他の適切な方法で告知します。ユーザーが告知後もサービスを利用し続ける場合、変更に同意したものとみなします。
• ポイントの有効期限：
  ポイントに有効期限を設定する場合、当該期限や利用条件は当団体が別途定めるガイドラインやアプリ内表示等に従うものとします。ユーザーが期限内に使用しなかったポイントは無効となる場合があります。
• 不正行為に対する措置：
  ユーザーが規約違反行為や不正行為を行った場合、当団体は事前の通知なくサブスクリプションの停止・解除、ポイントの没収等の措置を行うことができます。

12. 準拠法・裁判管轄

本規約の解釈および適用にあたっては、日本国法を準拠法とします。本サービスに関連して生じた紛争については、日本国の裁判所を第一審の専属的合意管轄とします。

Terms of Service

1. Introduction

These Terms of Service (hereinafter referred to as “Terms”) for this application (hereinafter referred to as “Service”) define the relationship between our organization (hereinafter referred to as “Organization”), which provides this Service, and the users of this Service (hereinafter referred to as “Users”). Please read these Terms carefully before using this Service.

2. Service Description

This Service provides a platform where Users can create and share comics online. Users can freely upload images and use them to create comics.

3. Copyright

The copyright of images, comics, and content (hereinafter referred to as “User Content”) created through this Service belongs to the User who created them. However, Users grant the Organization a non-exclusive, royalty-free license to use such content for the provision, improvement, and promotion of the Service.

4. Rights and Obligations Regarding Original Images

Regarding original images used by Users in this Service, Users guarantee that they possess the right to use such images, or have all the rights, permissions, and consents necessary to obtain usage rights. The Organization bears no responsibility for images uploaded or used by Users. In the event of claims from third parties related to the use of original images, Users shall resolve these at their own expense and responsibility.

5. Prohibited Actions

Users are prohibited from engaging in the following actions:

• Actions that violate laws and regulations
• Actions that infringe upon third-party intellectual property rights, such as copyrights and trademarks
• Actions that defame the Organization, other Users, or third parties
• Posting or sharing content unsuitable for viewing by individuals under 18 years of age (so-called “18+ content”), such as sexual or violent expressions
• Posting or sharing obscene materials, pornography, or content regulated from the perspective of youth protection as defined by Japanese laws and ordinances
• Other actions deemed inappropriate by the Organization

6. Removal and Suspension of Content

The Organization reserves the right to remove or suspend User Content without prior notice in the following cases:

• When the Organization determines that the content violates these Terms
• When the Organization determines that the content violates laws or public order and morals
• When the Organization determines that the content infringes upon the rights of third parties
• When the Organization, at its discretion, deems the content inappropriate

Users cannot object to the Organization’s decision to suspend or remove content. Furthermore, the Organization shall not be liable for any damages incurred by Users due to the removal or suspension of content.

7. Disclaimer

• The Organization shall not be liable for any content created or shared by Users through this Service.
• The Organization shall not be liable for any damages caused by interruption, suspension, or unavailability of the Service; loss of data; delay in data transmission or reception; or unauthorized access to data.
• In cases where Users input complex prompts or attempt to generate images containing sensitive content, the image generation system may not process them as intended due to service limitations. The Organization shall not be responsible for refunds or compensation in such cases.

8. Changes to the Terms

The Organization may change these Terms as necessary. The revised Terms will be notified to Users through display within the Service or by other appropriate methods.

9. Account-Related Provisions

The following provisions are established regarding accounts for this Service:

• In principle, Users may create one account per person. Multiple accounts are permitted only when each account has a clearly different purpose (e.g., one for general creation and another for commercial activities).
• Fraudulent activities using multiple accounts by the same individual (such as manipulating votes or rankings) are prohibited, and all accounts may be suspended.
• For accounts that have been inactive for more than 6 months, the Organization reserves the right to temporarily suspend or delete the account after prior notification.
• To reactivate a long-inactive account, Users may follow the prescribed procedures. However, account information or content may not be recoverable if already deleted.
• The transfer, sale, or lending of accounts is prohibited. If discovered, the relevant account may be suspended.

10. Provisions Regarding Monetization

The following provisions are established regarding the monetization of content created and published through this Service:

• Users have the right to commercially use their created works outside of this Service (such as in books or merchandise).
• However, for derivative works, Users must comply with the terms of use or guidelines established by the rights holders of the original work.
• When using creator support features within this Service (tips, support, etc.), fees may apply as separately specified.
• The following actions for the purpose of monetization are prohibited:
  • Fraudulently obtaining views through false or misleading content
  • Monetizing through unauthorized use of others’ works
  • Obtaining revenue by exploiting system vulnerabilities
• The Organization reserves the right to confiscate revenue and suspend the accounts of Users who violate these monetization rules.

11. Subscription Plans and Points

The Service may include a subscription plan (hereinafter referred to as “Subscription”), where Users pay a fixed monthly fee in exchange for receiving points on a regular basis. These points may be consumed within the Service (for example, when using image generation features).

• Subscription Details:
  If Users opt to use the Subscription, the monthly fee, amount of points granted, payment methods, and other details shall be provided in guidelines set by the Organization or displayed within the application.
• Payment and Cancellation:
  Users shall pay the Subscription fee according to the payment methods designated by the Organization. If a User wishes to cancel the Subscription, they must follow the Organization’s prescribed procedures. Cancellation takes effect once these procedures are completed. Depending on the cancellation timing, any fees already paid may not be refunded.
• Use and Consumption of Points:
  Points held by Users shall be consumed in accordance with the functions specified within the Service. The Organization may unilaterally change the rate of point consumption or the features for which points can be used. If such changes occur, the Organization will notify Users in principle at least 30 days prior to the effective date of the change.
• Changes to Fees, Points, and Other Terms:
  The Organization may revise fees, the amount of points granted, or other aspects of the Subscription plan. If revisions are made, Users will be notified in advance, in principle at least 30 days before the changes take effect, through in-app notifications or other appropriate methods. If Users continue to use the Service after such notification, they are deemed to have agreed to the changes.
• Validity of Points:
  The Organization may set an expiration date or usage conditions for points. The specifics of such conditions will be communicated in separate guidelines or in-app displays. Points that are not used within the validity period, if any is set, may become invalid.
• Measures Against Misconduct:
  If a User engages in actions that violate these Terms or are deemed fraudulent, the Organization may, without prior notice, suspend or terminate the Subscription, confiscate points, or take other measures as it deems necessary.

12. Governing Law and Jurisdiction

The interpretation and application of these Terms shall be governed by the laws of Japan. The courts of Japan shall have exclusive jurisdiction as the court of first instance for any disputes arising in connection with this Service.
